User Responsibility

User Responsibility

Users are advised to check the description of the services and trips carefully before making a booking. User(s) agree to be bound by all the conditions as contained in booking confirmation or as laid out in the confirmed booking voucher. These conditions are also to be read in consonance with the User Agreement.

If a User intends to make a booking on behalf of another person, it shall be the responsibility of the User to inform such person about the terms of this Agreement, including all rules and restrictions applicable thereto.

The User undertakes to abide by all procedures and guidelines, as modified from time to time, in connection with the use of the services available through BeauCo. The User further undertakes to comply with all applicable laws, regulations, orders, directions etc. issued by either the Central Government, State Government, District Authorities or any other statutory body empowered to do so w.r.t use of services or for each transaction.

The services are provided on an “as is” and “as available” basis. BeauCo may change the features or functionality of the services being provided at any time, in its sole discretion, without any prior notice. BeauCo doesn’t take any responsibility in case of any misguidance opted by the user(s) from other sources.

In case of any misbehavior by the associates of the BeauCo user(s) need to give an intimation to the BeauCo team, so that the necessary actions can be taken against the concerned associate(s) though BeauCo does not take any responsibility for any kind of loss, during the trip.

User also authorizes BeauCo’s representative to contact such a user over phone, message and email. This consent shall supersede any preferences set by such User through national customer preference register (NCPR) or any other similar preferences.

Cancellation Policy

At Beautiful Coordinates, we understand that plans change, and we strive to offer our customers flexible cancellation options. Below are the details of our cancellation policy.

Cancellations within 24Hrs after the booking of the trip will be eligible for a full refund.

Cancellations made after 24Hrs of the booking of the trip will not be eligible for a refund.

No-shows on the day of the trip will not be eligible for a refund.

In the event of a trip being canceled by Beautiful Coordinates , a full refund will be issued to all affected customers and an intimation will be sent to the registered Email address.

In the event of unforeseen circumstances (such as inclement weather), Beautiful Coordinates reserves the right to make changes to the itinerary or to cancel the trip with prior intimation to the affected customers. In such cases, a full refund will be issued to all affected customers.

Covid - 19 Terms, Conditions and Protocols

User agrees that due to recent outbreak of COVID-19 pandemic, which has been declared as a national disaster by the Government of India, there may be instances, where the end service provider either cancels the booking or refuses to provide the services, as agreed with the User, by assigning or not assigning any specific reason for such refusal. Refusal of service may be due to the reasons including but not limited to the User:

exhibiting any symptoms associated with COVID 19.

refusing to comply with safety advisories, like wearing protective gear, complying with social distancing norms etc.

suffering of any ailment making the User vulnerable to the virus

posing a threat to the health and safety of others

In such cases BeauCo will assume no liability for the refusal of service by the end service provider. The User also agrees that refund, if any, for such bookings will be processed by BeauCo to the User subject to receipt of the same from the end service provider.

User further understands that due to the outbreak of COVID-19, the Central Government through its ministries, State Governments and statutory bodies have/may come up with a detailed set of guidelines or standard operating procedure (SOP) that a traveler will have to follow in order to undertake the travel.

The User agrees to abide with all such guidelines/SOP while undertaking any travel. Failure to abide by such detailed set of guidelines/SOP, may lead to a situation where the service provider or any person authorized by the Central Government, State Government or statutory body may disallow the User to undertake the travel. In such circumstances, BeauCo will not be held liable for such refusal to travel and refund, if any, shall be strictly as per the terms of the service provider.

User understands that the Central Government, State Governments and various other bodies, may mandate downloading of Arogya Setu App or submitting a self- declaration form prior to entering a transit point like airport, railway station etc. or at the time of checking-in for a flight, into a hotel etc. Accordingly, the User must ensure downloading of Arogya Setu App on their smartphones or provide any other alternative such as self-declaration when demanded.

User undertakes that all bookings are subject to certain minimum medical wellbeing criteria specified by the Govt. / appropriate authority from time to time. User should have no medical history of the COVID-19 virus 28 days before the date of scheduled travel, especially in case of inbound travel. In this regard the User may be required to furnish a medical proof or health declaration in an applicable format.

Protocols to Follow

  1.  Wear a mask at all times in public places.
  2. Maintain a safe distance of at least 6 feet from others.
  3. Wash your hands frequently with soap and water or use hand sanitizer.
  4. Avoid touching your face, especially your mouth, nose and eyes.
  5. Cover your mouth and nose while coughing or sneezing with a tissue or your elbow.
  6. Avoid close contact with people who are sick.
  7. Avoid large gatherings and crowded places.
  8. Stay in your room as much as possible and avoid common areas.
  9. Regularly clean and disinfect high-touch surfaces such as doorknobs and light switches.
  10. Follow the instructions of local health authorities, including any quarantine requirements.
  11. Monitor your health and seek medical attention if you develop symptoms.
  12. Follow any additional guidelines set by the specific location you are visiting.
  13. Keep a record of the places you have been and the people you have been in contact with.
  14. Avoid non-essential travel to areas with high transmission rates.
  15. Always follow local guidelines and regulations, even if they differ from your home country.

Fees and Payment

In addition to the cost of booking as charged by the Service Providers, BeauCo reserves the right to charge certain fees in the nature of convenience fees or service fees. BeauCo further reserves the right to alter any and all fees from time to time. Any such additional fees, including fee towards any modifications thereof, will be displayed to the User before confirming the booking or collecting the payment from such User.

In cases of short charging of the booking amount, taxes, statutory fee, convenience fee etc., owing to any technical error or other reason, BeauCo shall reserve the right to deduct, charge or claim the balance amount from the User and the User shall pay such balance amount to BeauCo. In cases where the short charge is claimed prior to the utilization of the booking, BeauCo will be at liberty to cancel such bookings if the amount is not paid before the utilization date.

Any increase in the price charged by BeauCo on account of change in rate of taxes or imposition of new taxes, levies by Government shall have to be borne by the User. Such imposition of taxes, levies may be without prior notice and could also be retrospective but will always be as per applicable law.

In the rare circumstance of a booking not getting confirmed for any reason whatsoever, BeauCo will process the refund of the booking amount paid by the User and intimate the User about the same. BeauCo is not under any obligation to provide an alternate booking in lieu of or to compensate or replace the unconfirmed booking. All subsequent bookings will be treated as new transactions. Any applicable refund will be processed as per the defined policies of the service provider and BeauCo as the case may be.

The User shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the service, as per the applicable laws

The User agrees and understands that all payments shall only be made to bank accounts of BeauCo. BeauCo or its agents, representatives or employees shall never ask a customer to transfer money to any private account or to an account not held in the name of BeauCo. The User agrees that if that user transfers any amount against any booking or transaction to any bank account that is not legitimately held by BeauCo or to any personal account of any person, BeauCo shall not be held liable for the same. User shall not hold any right to recover from BeauCo any amount which is transferred by the User to any third party.

The User will not share his personal sensitive information like credit/debit card number, CVV, OTP, card expiry date, user IDs, passwords etc. with any person including the agents, employees or representatives of BeauCo. The User shall immediately inform BeauCo if such details are demanded by any of its agents’ employees or representatives. BeauCo shall not be liable for any loss that the User incurs for sharing the aforesaid details.

Refunds, if any, on canceled bookings will always be processed to the respective account or the banking instrument (credit card, wallet etc.) from which payment was made for that booking.

Booking(s) made by the User through BeauCo are subject to the applicable cancellation policy as set out on the booking page or as communicated to the customers in writing.

BeauCo provides various modes of making payments on the Website for transacting, like UPI, Credit/Debit Cards of various banks, Net Banking facility of all major banks.

Forced Majeure

There can be exceptional circumstances where BeauCo and / or the Service Providers may be unable to honor the confirmed bookings due to various reasons like act of God, labor unrest, insolvency, a pandemic, an epidemic, business exigencies, government decisions, terrorist activity, any operational and technical issues, route and flight cancellations etc. or any other reason beyond the control of BeauCo. If BeauCo has advance knowledge of any such situations where dishonor of bookings may happen, it will make its best efforts to provide a similar alternative to the User or refund the booking amount after deducting applicable service charges, if supported and refunded by that respective service operator(s). The User agrees that BeauCo being merely a facilitator of the services and products booked, cannot be held responsible for any such Force Majeure circumstance. The User has to contact the Service Provider directly for any further resolutions and refunds.

The User agrees that in the event of non-confirmation of booking due to any technical reasons (like network downtime, disconnection with third party platforms such as payment gateways, banks etc.) or any other similar failures, BeauCo’s obligation shall be limited refunding the booking amount, if any, received from the customer. Such refund shall completely discharge BeauCo from all liabilities with respect to that transaction. Additional liabilities, if any, shall be borne by the User.

In no event shall BeauCo and be liable for any direct, indirect, punitive, incidental, special or consequential damages, and any other damages like damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Website or any other Sales Channel.

Indemnification

The User agrees to indemnify, defend and hold harmless BeauCo, its affiliates and their respective officers, directors, lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by such indemnified persons, that arise out of, result from, or may be payable by virtue of, any breach of any representation or warranty provided by the User, or non-performance of any covenant by the User.

The User shall be solely liable for any breach of any country specific rules and regulations or general code of conduct and BeauCo cannot be held responsible for the same.

Host Terms

Hosting on BeauCo.

As a Host, BeauCo offers you the right to use the BeauCo Platform to share your Accommodation, Experience, or other Host Service with our vibrant community of Guests – and earn money doing it. It’s easy to create a Place and you are in control of how you host – set your price, availability, and rules for each Place.

Contracting with Guests

When you accept a booking request, or receive a booking confirmation through the BeauCo Platform, you are entering into a contract directly with the Guest, and are responsible for delivering the Host Service under the terms and at the price discussed with us earlier. BeauCo Payments will deduct amounts you owe from your payout unless we and you agree to a different method.

Independence of Hosts

Your relationship with BeauCo is that of an independent individual or entity and not an employee, agent, joint venturer or partner of BeauCo, except that BeauCo Payments acts as a payment collection agent as described in the Payments Terms. BeauCo does not direct or control your Host Service and you understand that you have complete discretion whether and when to provide Host Services and at what price and on what terms to offer them.

Know Your Legal Obligations

You are responsible for understanding and complying with any laws, rules, regulations and contracts with third parties that apply to your Place or Host Services. For example: Some landlords and leases, or homeowner and condominium association rules, restrict or prohibit subletting, short-term rentals and/or longer-term stays. Some cities have zoning or other laws that restrict the short-term rental of residential properties. Some jurisdictions require Hosts to register, get a permit, or obtain a license before providing certain Host Services (such as short-term rentals, longer-term stays, preparing food, serving alcohol for sale, guiding tours or operating a vehicle). In some places, the Host Services you want to offer may be prohibited altogether. Some jurisdictions require that you register Guests who stay at your Accommodation. Some jurisdictions have laws that create tenancy rights for Guests and additional obligations for Hosts. For example, some places have landlord-tenant, rent control, and eviction laws that may apply to longer stays. Check your local rules to learn what rules apply to the Host Services you plan to offer. Information we provide regarding legal requirements is for informational purposes only and you should independently confirm your obligations. You are responsible for handling and using personal data of Guests and others in compliance with applicable privacy laws and these Terms, including our Host Privacy Standards. If you have questions about how local laws apply you should always seek legal advice.

Your Responsibilities

You are responsible for your own acts and omissions and are also responsible for the acts and omissions of anyone you allow to participate in providing your Host Services. You are responsible for setting your price and establishing rules and requirements for your Place. You must describe any and all fees and charges in your Place and may not collect any additional fees or charges outside the BeauCo Platform. Do not encourage Guests to create third-party accounts, submit reviews, provide their contact information, or take other actions outside the BeauCo Platform in violation of our Off-Platform Policy.

Hosting as a Team or Organization

If you work with a co-host or host as part of a team, business or other organization, the entity and each individual who participates in providing Host Services, is responsible and liable as a Host under these Terms. If you accept terms or enter into contracts, you represent and warrant that you are authorized to enter into contracts for and bind your team, business or other organization, and that each entity you use is in good standing under the laws of the place where it is established. If you perform other functions, you represent and warrant that you are authorized to perform those functions. If you instruct BeauCo to transfer a portion of your payout to a co-host or other Hosts, or send payments to someone else, BeauCo will not entertain the same.

Cancellations, Travel Issues, and Booking Modifications

Cancellations and Travel Issues. In general, if a Guest cancels a reservation, the amount paid to you is determined by the cancellation policy that applies to that reservation. As a host, you should not cancel on a Guest without a valid reason under our Extenuating Circumstances Policy or applicable law. If you cancel on a Guest without such a valid reason,
we may impose a cancellation fee and other consequences. If:
(i) a Guest experiences a Travel Issue (as defined by the Rebooking and Refund Policy), (ii) an Extenuating Circumstance arises, the amount you are paid will be reduced by the amount we refund or otherwise provide to the Guest, and by any other reasonable costs we incur as a result of the cancellation. If a Guest receives a refund after you have already been paid, or the amount of the refund and other costs incurred by BeauCo exceeds your payout, BeauCo (via BeauCo Payments) may recover that amount from you, including by offsetting the refund against your future payouts. You agree that BeauCo’s Rebooking and Refund Policy, Extenuating Circumstances Policy, and these Terms preempt the cancellation policy you set in situations where they allow for the cancellation of a Reservation and/or the issuance of refunds to Guests. If we reasonably expect to provide a refund to a Guest under one of these policies, we may delay release of any payout for that Reservation until a refund decision is made.

Booking Modifications

Hosts and Guests are responsible for any Booking Modifications they agree to make via the BeauCo Platform or direct BeauCo customer service to make on their behalf, and agree to pay any additional amounts, fees or taxes associated with a Booking Modification.

Taxes

As a Host, you are responsible for determining and fulfilling your obligations under applicable laws to report, collect, remit or include in your price any applicable VAT or other indirect taxes, occupancy taxes, tourist, income or other taxes (“Taxes”).

Tax Information

In certain jurisdictions, Tax regulations may require that we collect and/or report Tax information about you, or withhold Taxes from payouts to you, or both. If you fail to provide us with documentation that we determine to be sufficient to support any such obligation to withhold Taxes from payouts to you, we may withhold payouts up to the amount as required by law, until sufficient documentation is provided. You agree that BeauCo may issue on your behalf invoices or similar documentation for VAT, GST, consumption or other Taxes for your Host Services to facilitate accurate tax reporting by our Guests and their organizations.

Vlogger Terms 

Definition of Terms:

  1. “Vlogger”: refers to the individual or entity that creates and submits videos to the BeauCo.
  2. “BeauCo”: refers to the company, its affiliates and respective officers, directors, employees and agents.
  3. “Materials”: refers to all videos, images, audio, text and other content submitted by the Vlogger to the BeauCo.
  4. “Platform”: refers to the website, mobile app or any other medium through which the BeauCo showcases the Materials.

Grant of Rights:

  1. The Vlogger grants the BeauCo a perpetual, non-exclusive, worldwide, royalty-free, sublicensable and transferable license to use, copy, modify, distribute, display, perform and create derivative works of the Materials on the Platform or in any other medium for the purpose of promoting the BeauCo and its services.
  2. The Vlogger represents and warrants that they own all rights in the Materials, including but not limited to the rights to the intellectual property contained in the Materials and have obtained all necessary permissions for the use of the Materials.

Content Requirements:

  1. The Vlogger shall ensure that the Materials submitted are accurate, truthful and do not infringe upon the rights of any third party.
  2. The BeauCo reserves the right to reject or remove any Materials that it deems to be inappropriate, misleading or in violation of the Terms and Conditions.

Payment:

  1. The BeauCo may compensate the Vlogger for the Materials submitted, as per the agreement between the parties.
  2. The payment, if any, shall be made through a mutually agreed mode of payment.

Termination:

  1. The license granted by the Vlogger shall survive termination of the Terms and Conditions.
  2. Either party may terminate the Terms and Conditions at any time by providing written notice to the other party.

Terms of Service:

Introduction:

The BeauCo provides the Platform to showcase the Materials created by the Vloggers.

The Vlogger agrees to use the Platform in accordance with the Terms and Conditions and the Terms of Service.

Eligibility:

The Vlogger represents and warrants that they are at least 18 years of age or have the legal capacity to enter into a binding agreement.

Use of Platform:

  1. The Vlogger may only use the Platform for lawful purposes and in accordance with the Terms and Conditions and the Terms of Service.
  2. The Vlogger shall not use the Platform to transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters or any other form of unsolicited commercial communication.

User Account:

  1. The Vlogger may be required to create a user account in order to submit the Materials to the BeauCo.
  2. The Vlogger shall be solely responsible for maintaining the confidentiality of their account information and for all activities that occur under their account.

Modification of Terms:

  1. The BeauCo reserves the right to modify the Terms and Conditions and the Terms of Service at any time, without prior notice to the Vlogger.
  2. The Vlogger is responsible for regularly reviewing the Terms and Conditions and the Terms of Service for any updates.

Disclaimer of Warranty:

The Platform is provided on an “as is” and “as available” basis, without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose or non-infringement.

Miscellaneous

SEVERABILITY: If any provision of this User Agreement is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this User Agreement shall continue to be in full force and effect.

JURISDICTION: This Agreement is subject to interpretation as per the laws of India, and the parties shall refer any unresolved disputes to the exclusive jurisdiction of courts in Delhi.

AMENDMENT TO THE USER AGREEMENT: BeauCo reserves the right to change the User Agreement from time to time. The User is responsible for regularly reviewing the User Agreement.

CONFIDENTIALITY: Any information which is specifically mentioned by BeauCo as confidential shall be maintained confidentially by the User and shall not be disclosed unless as required by law or to serve the purpose of this User Agreement and the obligations of both the parties herein.

FEEDBACK FROM CUSTOMER: BeauCo would like to know the feedback of the Users for improving its services. The User hereby authorizes BeauCo to contact the User for their feedback on various services offered by BeauCo. Such feedback may be collected through emails, telephone calls, SMS or any other medium from time to time. In case the User chooses not to be contacted, such User shall write to BeauCo for specific exclusion at our beautifulcoordinates@gmail.com.
